Essere la prima donna al vertice dell’istituzione forense è una forte emozione, ma ancora più forte è il senso del dovere che avverto per il particolare momento e per le difficoltà che l’avvocatura sta affrontando sotto molteplici aspetti. Sono grata e soddisfatta del riconoscimento unanime espresso dai consiglieri. Il tempo che resta al completamento della consiliatura certamente non è molto ampio, ma faremo in modo che sia denso e produttivo.
La categoria forense, sul fronte del gender gap, è da anni in una posizione di sostanziale equilibrio numerico tra avvocate e avvocati: anche nella rappresentanza istituzionale le presidenti donne degli Ordini territoriali sono circa un terzo e le consigliere elette sfiorano il 42%.
La nostra riforma professionale, approvata dal Parlamento nel 2012, è stata la prima – in Italia e in Europa – a introdurre il principio di democrazia paritaria con un meccanismo che garantisce che nella competizione elettorale ci sia un’equa rappresentanza dei generi. Il fatto che io sia la prima donna, in quasi un secolo di storia, Presidente del Consiglio nazionale forense è segno però della sensibilità che l’avvocatura oggi forse prima e di più rispetto ad altre professioni manifesta sui temi della parità di genere.
Non c’è da meravigliarsi del fatto che nella nostra professione l’esigenza di un equilibrio di genere sia forte e condivisa: lo si deve anche all’avvocatura femminile, che da decenni si impegna molto in tal senso. Del resto la nostra funzione sociale, che ci porta a occuparci di temi sensibili, non ultimo quello relativo alla tutela di ogni genere di discriminazioni, ci rende particolarmente attenti e vigili. Gli ultimi dati sull’avvocatura, che saranno elaborati da Censis e Cassa forense nel prossimo rapporto in uscita a marzo, rivelano un dato noto ma per non per questo meno preoccupante: il divario di genere fra uomini e donne nel trattamento economico. Se sotto i 30 anni avvocati e avvocate sono praticamente appaiati nei redditi dichiarati, circa 15 mila euro l’anno i primi, circa 12.500 le seconde, questa differenza va progressivamente aumentando nelle fasce d’età superiori, fino a scavare un vero e proprio abisso retributivo. Il gap si amplia notevolmente dai 35 anni in poi e che va progressivamente aumentando man mano che l’età sale: una donna avvocato guadagna poco meno di 32 mila euro nella fascia 55-59; un uomo sfiora i 70 mila. Alla fine, la media reddituale di tutte le fasce d’età vede le avvocate dichiarare poco più di 23 mila euro l’anno; gli avvocati invece superano i 50 mila.
Ma non sono solo numeri: sono progetti, ambizioni, aspettative, desideri che meritano di essere protetti e custoditi. Ogni cancellazione dall’albo che non sia frutto di scelta libera e incondizionata è un fallimento non delle avvocate (o avvocati) che rinunciano ma della società che perde una opportunità di tutela.
