Il correntismo interno alla magistratura erode non solo il ruolo della politica ma anche la carriera delle donne, compromettendo pertanto il funzionamento e l’efficienza della giustizia. Basti pensare che se è vero che su 9.534 magistrati italiani, sono 4.213 gli uomini e 5.321 le donne, è altrettanto vero che tre magistrati su quattro (71%), tra coloro che esercitano funzioni direttive, sono uomini.
Le dichiarazioni del ministro Crosetto al Corriere della Sera, pertanto, ci riguardano più da vicino di quello che pensiamo. Infatti, si è riferito esplicitamente alle organizzazioni interne alla magistratura; ovvero, quelle “correnti” che pensano di rappresentare il potere giudiziario, ma non ne sono altro che una distorsione basata su una presunta superiorità morale, politica e culturale. Superiorità morale divenuta, dagli anni ’60 a oggi, corporativismo per permettere ai magistrati di fare carriera e spartirsi le cariche.
Del resto il caso Palamara lo ricordiamo tutti: gli incontri, le chat, le relazioni, il sistema di potere attraverso cui le correnti si dividevano le nomine negli uffici giudiziari, fino ad arrivare al Consiglio Superiore della Magistratura che, più di tutti, dovrebbe assicurare l’indipendenza e l’autogoverno dei magistrati.
La politica dubita dell’indipendenza del potere giudiziario, mentre i cittadini italiani ne sono piuttosto certi. L’eurobarometro 2023 relativo al Quadro di valutazione UE della giustizia, fornisce una panoramica annuale e dati comparativi sull’efficienza, sulla qualità e sull’indipendenza dei sistemi giudiziari degli Stati membri. Il giudizio dei nostri cittadini è piuttosto impietoso.
L’Eurobarometro infatti afferma che, rispetto alla maggior parte degli Stati Membri dell’Unione Europea, in Italia il grande pubblico percepisce l’indipendenza dei tribunali e dei giudici in maniera molto negativa o abbastanza negativa, con un piccolo e lieve miglioramento rispetto agli anni precedenti.
Insomma, non alberga in Italia il principio, affermato anche dalla Corte europea dei diritti dell’uomo, Justice must not only be done, but must also be seen to be done, secondo cui è necessario evitare qualsiasi apparenza di pregiudizio, anche quando non ce n’è.
Non a caso, la salute dello Stato di Diritto è misurata dall’indipendenza della magistratura, l’equità dei procedimenti giudiziari e la fiducia dei cittadini e delle imprese nel sistema legale. E poiché il Parlamento Europeo spesso si occupa dello Stato di Diritto in Europa e nel Mondo, già nel 2021, ho presentato una proposta di risoluzione sul principio di indipendenza dei giudici, chiedendo che si dichiari che tale principio venga considerato violato anche quando il giudice si trova in una situazione di dipendenza da altri soggetti, come associazioni corporative-sindacali che hanno il potere sostanziale di decidere la sua carriera.
Matteo Salvini e la Lega si sono sempre battuti per una giustizia più giusta e garante dei diritti dei cittadini attraverso referendum, leggi e iniziative.
Riforme radicali, sistematiche e omogenee sono impellenti. Il tema dell’esame psicoattitudinale per la magistratura non è uno scandalo ma una pratica piuttosto comune in molti Stati europei come Francia, Austria e nei Land tedeschi. La separazione delle carriere e le valutazioni delle carriere dei magistrati sono obbiettivi a cui il Paese non può rinunciare.
Sarà con la tenacia di una donna, Giulia Bongiorno, Presidente Commissione Giustizia del Senato della Repubblica, che molti di questi risultati verranno portati a compimento.
Quella del ministro Crosetto non è, quindi, solo una legittima difesa della politica ma è una difesa della magistratura da sé stessa, dall’idea che il principio di imparzialità e indipendenza non si esercitano in nome delle correnti e a discapito della vita pubblica dell’Italia. È con una magistratura libera da associazioni corporative-sindacali che le donne potranno attestare il loro ruolo nella giustizia.
